TERMS AND CONDITIONS OF HOLIDAY RENTALS

1) THE PROPERTY

  • The property is known as Le Dragon Vert, Mas de Cazelles, Ginals, 82330 Verfeil Sur  Seye, Tarn et Garonne, France. It is offered for Holiday Rentals, subject to confirmation by the Owners, Mr and Mrs Michael Nicholson, to yourself as the Renter

2) BOOKINGS AND PAYMENTS

  • To reserve the property, a non-refundable deposit of 30% of the total cost of your holiday rental must be paid. Once your completed and signed Booking Form and deposit is received and cleared, your booking will be confirmed to you in writing. This represents formal acceptance of your booking

  • The balance (i.e. 70%) of the total cost of your holiday rental must be paid not less than 8 weeks prior to the start of your holiday rental period. If full payment is not received by the due date, the Owners reserve the right to cancel your reservation. Your 30% deposit will then be forfeited

  • If your booking is made less than 8 weeks before the start of your holiday rental period, the total cost must be paid in full immediately in order to secure your booking

  • A security bond of £250 per week is required in case of any damage or breakages sustained to the property, the swimming pool and/or the property contents and is payable with the balance of the rent. However, the sum reserved by this clause will not limit your liability to the Owner in the event of significant damage or breakages incurred. The security bond is fully refundable and will be returned to you within 21 days of the end of the rental period, subject to any damages or breakages occurring

3) CANCELLATIONS

  •  If you cancel your booking 8 weeks or more prior to the start of your holiday rental period, the 30% deposit will be forfeited. However, the security bond will be returned to you in full

  •  If you cancel your booking less than 8 weeks prior to the start  of your holiday rental period, the full cost of your holiday will be forfeited. However, the security bond will be returned to you in full

  •  If for any reason the Owner needs to cancel your holiday booking, you will receive a full refund of the monies you have paid. However, under no circumstances will the Owner’s liability exceed the amount paid by you for the rental period

4) CARE OF THE PROPERTY

  • It is your responsibility to take good care of the property, swimming pool and its contents throughout your stay and to read and comply with the “house rules”. Any breakages or damage to the property, pool and/or its contents will be deducted from the security bond

  •  You are expected to leave the house and pool in a clean and tidy state when you vacate it. If the house and/or pool is left in an unsatisfactory condition, the cost of cleaning the property and/or pool will be deducted from the security bond

  • You are also expected at all times to ensure that the swimming pool is used in a safe and responsible manner and that children or inexperienced swimmers are fully supervised at all times. You will be expected to comply fully with any safety measures in relation to the swimming pool, including the pool cover, and respect the house rules with regard to maintaining proper pool operation and cleanliness

  • It is your responsibility to report any problems with the house, contents and/or swimming pool to the local representative and to allow them access to the house to attend to these problems. All reasonable attempts will be made to rectify any problems as soon as is reasonably practicable

  • You are expected to act in a way that will not cause unreasonable disturbance to the local residents during the holiday rental period

  • The house sleeps up to 7 guests and this must not be exceeded under any circumstances

  • Smoking is strictly prohibited under any circumstances at the property

  • Pets are not permitted on the property, unless with prior agreement with the Owner

  • No camping is permitted on the property grounds

5) ARRIVAL AND DEPARTURE TIMES

  • You are requested not to arrive at the house any earlier than 4pm on the first day and to leave by 10am at the latest on the day of departure, unless prior arrangements have been agreed with the Owner

6) OTHER ISSUES

  • The Owner is not liable for any loss or damage incurred or injury sustained at the property or in its grounds. You are strongly advised to arrange your own comprehensive travel insurance (including cancellation cover) and to have full cover for all your personal belongings, etc since these are not covered by the Owner’s insurance

  • The Owner will not be liable to the Renter:-

-          for any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner

 -          for any temporary defect or stoppage in the supply of public services to the property beyond the Owner’s control

-       for any loss, damage or inconvenience caused or suffered by the Renter if the property is destroyed or substantially damaged before the start of the rental period. In any such event, the Owner will, within 7 days of notification to the Renter, refund to the Renter all sums previously paid in respect of the rental period

  • The use of the accomodation is entirely at the Renter's risk and no responsibility can be accepted for injury to the Renter, members of the Renter's group or visitor and any loss or damage to the belongings of the Renter, the Renter's group or visitor

  • No responsibility can be accepted for any loss or damage to any motor vehicle or its contents

  • Under no circumstances shall the Owner's liability to the renter exceed the amount paid to the Owner for the rental period

  • The Contract between you as the Renter and the Owner and acceptance of these Terms and Conditions will be governed in accordance with English Law and each party submits to the exclusive jurisdiction of the English Courts in the event of any dispute
